Il est pris en application de l&rsquo;article 5 de l aloi du 6 juillet 1989, modifi\u00e9 par la loi ALUR du 24 mars 2014 qui pr\u00e9voit que les honoraires de l&rsquo;interm\u00e9diaire sont \u00e0 la charge exclusive du bailleur \u00e0 l&rsquo;exception des honoraires portant sur les prestations de visite du preneur, de constitution de dossier et de r\u00e9daction du bail ainsi que d&rsquo;\u00e9tat des lieux d&rsquo;entr\u00e9e. Ces derniers sont partag\u00e9s entre le bailleur et le preneur mais le montant toutes taxes comprises imput\u00e9 au locataire pour ses prestations ne peut exc\u00e9der celui imput\u00e9 au bailleur et est plafonn\u00e9 par d\u00e9cret. En effet, il est r\u00e9gi par les dispositions les plus g\u00e9n\u00e9rales des articles 1713 et suivants du code civil. L\u2019article 1713 et suivants (section 1, 2 et 3) du code civil r\u00e9gissent les conditions du bail civil. Le bail civil peut concerner les particuliers, les associations soumises \u00e0 la loi de 1901, et dans certains cas les entreprises.
